It is not uncommon for the mother of a child to inform a father that she intends to move out of Nevada with the Parties' child. It is understandable why many fathers feel helpless in this situation. In such a situation, the mother must prove to a Court why she should be able to move. It is not the father's burden to prove that the move should not occur.
As we have previously discussed, a Nevada father's rights are equal to those of a mother. If you share joint custody and the mother wishes to move then she must demonstrate that the move is in the child's best interests. If the mother has primary custody of the child then she must demonstrate that 1) her request to move is brought in good faith; and 2) that the child will gain a benefit from the move.
